Welcome to Captio AI Pro (the "App"), an AI-powered application providing hashtag generation, caption suggestions, post ideas, and related content creation tools.

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and the owner/operator of the App ("we", "us", "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Use of the Service

The App provides AI-generated content suggestions including but not limited to hashtags, captions, and text ideas for social media and other platforms ("Service").

You may use the Service only for lawful purposes and in accordance with these Terms.

2. Accounts & Access to Features

Some features of the App are provided free of charge with limitations. Advanced or unlimited features require a paid subscription or one-time purchase.

We use RevenueCat to handle payments, subscriptions, and access entitlements. All purchases are governed by:

• Apple App Store Terms of Service (iOS)
• Google Play Terms of Service (Android)
• RevenueCat Terms of Service

Available Plans

• Monthly Subscription — recurring monthly access
• Yearly Subscription — recurring annual access (typically offered at a discount compared to monthly)
• Lifetime / One-time Purchase — non-recurring payment for permanent access (subject to availability)

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage subscriptions and turn off auto-renewal through your App Store / Google Play account settings.

We reserve the right to modify, introduce, or discontinue any plans or features at any time. Any changes to plans or pricing will be notified in advance where required by applicable law.

3. Payments & Refunds

All payments are processed via Apple App Store, Google Play, or RevenueCat. We do not store your payment information.

Refunds: We generally do not offer refunds except as required by applicable law or the policies of the Apple App Store/Google Play. Lifetime/one-time purchases are non-refundable except in very limited circumstances determined solely by us or the relevant app store.

You are responsible for any taxes, fees, or charges imposed by your payment provider or local authorities.

4. AI-Generated Content & Ownership

The App uses artificial intelligence to generate content suggestions. Outputs are based on training data and algorithms and may be similar to content generated for other users.

You own the content you input into the App and the AI-generated output you receive, subject to the following:

• You may use, modify, publish, and monetize the generated content for personal or commercial purposes.
• We claim no ownership over your final generated content.
• However, we retain all rights to the underlying models, technology, prompts, algorithms, and training data.

Important: AI outputs may contain inaccuracies, biases, hallucinations, or inappropriate content. You are solely responsible for reviewing, editing, and using any generated content.

5. User Conduct & Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or to generate harmful, defamatory, obscene, infringing, or abusive content
• Attempt to reverse engineer, decompile, copy, modify, or extract the AI models, prompts, or underlying technology
• Use automated means (bots, scrapers, etc.) to access or collect data from the Service
• Impersonate any person or entity or provide false information
• Interfere with the operation of the Service or other users' enjoyment of it

6. Intellectual Property

The App, including its design, text, graphics, AI technology, software, and trademarks (except your input/output), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or USD $100 if no payment was made).

8. Termination

We may suspend or terminate your access to the Service at any time, without notice, for any reason, including violation of these Terms.

Subscriptions will continue until the end of the paid period unless terminated earlier due to breach.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App, email, or other reasonable means. Your continued use after such changes constitutes acceptance of the updated Terms.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Pakistan. Any disputes arising out of or in connection with these Terms shall be resolved exclusively in the courts of Rahim Yar Khan / competent courts in Punjab, Pakistan, unless mandatory consumer protection laws applicable to you provide otherwise.
